Personal Data Processing Policy
FUNDACIÓN FRATERNIDAD MEDELLÍN informs its stakeholders of the Privacy and Personal Data Protection Policy adopted in compliance with Statutory Law 1581 of 2012, Decree 1377 of 2013, and other applicable regulations regarding Habeas Data in Colombia.
As the Data Controller and/or Data Processor, as applicable, FUNDACIÓN FRATERNIDAD MEDELLÍN handles personal data of its stakeholders in accordance with its mission, complying with the principles and regulations established in Colombian law and in the Foundation’s internal privacy and data protection policy.
Personal data held by FUNDACIÓN FRATERNIDAD MEDELLÍN will be processed for the following general purposes:
- To fulfill obligations arising from civil or commercial contracts and other legal agreements entered into by FUNDACIÓN FRATERNIDAD MEDELLÍN in pursuit of its mission.
- To comply with obligations and/or commitments derived from relationships—contractual or otherwise—with its stakeholders.
- To meet legal obligations involving the personal data of its stakeholders.
- To carry out projects that support the social development of its stakeholders.
- To manage relationships with stakeholders.
- To communicate information to stakeholders about projects related to social, cultural, scientific, technological, health, sports, and educational development, as well as publications, training events, and activities aligned with the Foundation’s mission—whether or not they are organized directly by FUNDACIÓN FRATERNIDAD MEDELLÍN.
- To carry out corporate social responsibility activities directed at its stakeholders.
- To manage the security of people, property, and information assets under the Foundation’s care.
In each business process, depending on the personal data collected and the type of processing involved, specific purposes, the legal name of FUNDACIÓN FRATERNIDAD MEDELLÍN, and its contact details will be provided in a prior privacy notice. If data processing is carried out by a data processor, it will do so under the general guidelines of FUNDACIÓN FRATERNIDAD MEDELLÍN, respecting the rights of the data subjects and ensuring mechanisms are in place to share the respective privacy and data protection policies.
Anyone belonging to a stakeholder group of FUNDACIÓN FRATERNIDAD MEDELLÍN, either as a data subject or an authorized party, has the following rights concerning the processing of their personal data—without prejudice to applicable legal provisions:
- To exercise their Habeas Data rights, which include the right to access, update, and correct their personal information, as well as to revoke consent for its use, when applicable under current law. This must be done through the channels provided by the Foundation, as detailed in this Policy.
- To request proof of the consent granted, except where legal authorization exists for processing, or it takes place under a contractual relationship.
- To be informed about the use given to their personal data, by submitting a request through the appropriate communication channels.
- To pursue any actions recognized by law concerning personal data protection and Habeas Data rights.
To exercise their Habeas Data rights or request access to their personal data, the data subject or a party with legitimate interest must contact the Foundation through the following channels: Email: [email protected] Postal address: Datos Personales – Fundación Fraternidad Medellín, Carrera 43A No. 1 – 50, San Fernando Plaza, Office 1352, Medellín.
Requests must include a detailed description of the matter related to their personal data, along with their contact details to enable the Foundation to process and respond to the request appropriately.
Required contact details include: full name, type and number of identification document, physical address, city, telephone number, and email address.
Upon receiving the request, FUNDACIÓN FRATERNIDAD MEDELLÍN will respond to the data subject or legally authorized party within the timeframes established by law.
This Policy was approved by FUNDACIÓN FRATERNIDAD MEDELLÍN and has been in effect since September 30, 2016.
